Privacy Statement

Latrobe Health Services recognises the importance of protecting your privacy and has procedures in place to protect your personal information. You can ask for a copy of our Privacy Policy at any time, or read it below.

What personal information does Latrobe collect?

We collect the personal information needed to process your membership application and to provide you with the quality and range of services you expect from a caring and professional health fund. For example, to assess claims and pay benefits and to promote and market other products and services that we believe will interest you.

In most situations, Latrobe collects personal information directly from you. However, we may also collect it from hospital, medical and ancillary health service providers and sometimes from government agencies.

How does Latrobe use your personal information?

Latrobe takes great care to protect your personal information. Sometimes we may have to disclose it on a need to know basis to third parties such as:

  • Hospital & medical providers, when settling claims and confirming cover entitlements.
  • Mailing houses, Internet and other IT service suppliers and our professional advisors.
  • To comply with legal requirements for the collection and submission of health related data to government agencies.

You may choose not to provide any personal information we request, or refuse us permission to disclose it, but if you exercise this right we may not be able to offer the service you require. Privacy Policy - Latrobe Health Services

This privacy policy sets out the Latrobe Health Services ("Latrobe") commitment to your privacy and the protection of your personal information.  Please read this privacy policy carefully, and if you have any questions, please contact us.  Copies of our privacy policy are available at your nearest branch Or, call our Privacy Officer on 1300 362 155 EST 8:30 am - 5:30 pm, Monday - Friday, or e-mail us at privacy@lhs.com.au.

While our primary relationship is with the member named as the policy holder, in the case of family cover policies, our commitment to privacy extends beyond the member named as a policy holder to all dependants covered by that policy.  In fact, our commitment to privacy covers all persons whose personal information we hold. Therefore, any reference in this privacy policy to "you" should be taken to mean and include a reference not only to the member named as the policy holder, but also to any dependants of that member and any other persons whose personal information we hold. 

By this Privacy Policy Latrobe undertakes to observe the terms of the Privacy Act 1988 (Cth) (the "Privacy Act") and the National Privacy Principles which are part of that Act.

A copy of the National Privacy Principles may be obtained from the Office of the Federal Privacy Commissioner or downloaded from the Commissioner's web site at www.privacy.gov.au.

Collection of personal information

Personal information is any information or an opinion about you where your identity is apparent or can reasonably be ascertained.  It includes almost all information which is in some way connected to you.  It goes beyond your name, address and contact details and includes any sensitive information and health information that we hold and which can be identified as being information relating to you.

At Latrobe, we may hold personal information relating to you which is the subject of this Privacy Policy including the following:

  • a record of your name, address, age, dependants and contact details including telephone numbers and in some cases facsimile numbers, e-mail addresses and Post Office box numbers;
  • depending upon whether you have made a claim, information concerning your health and any medical treatment, including details of where, when and from whom you have received that medical treatment and the nature of that treatment;
  • depending upon how you pay your premiums, bank account and/or credit card details;
  • details concerning your premiums and claims (if any) history;
  • Medicare numbers of you and your dependants;
  • if you pay your premiums through a payroll deduction scheme information concerning your employer; and
  • information concerning
  • applications made and payments in respect of other products and services which we supply either directly or as agents for others including general and travel insurance and ambulance cover.

Some of the personal information we hold may be exempt from the strict compliance requirements of the National Privacy Principles.  For example some health information we may be required by law to collect and disclose to government agencies.  How we use and disclose this personal information may determine whether or not it is subject to this Privacy Policy and the National Privacy Principles.

Collection of your personal information

We will not collect from you any personal information unless that personal information is necessary for one or more of our functions or activities and where lawful and practicable, we will let you deal with us on an anonymous basis should you prefer.  However, we recognise that this will not be practicable in many instances..  In any event, we will always collect your personal information by lawful and fair means and not in an unreasonably intrusive way.  When collecting sensitive (including health information), we will only do so with your consent or in accordance with the National Privacy Principles.

At or before the time we collect personal information about you (or if that is not practicable, as soon as practicable thereafter), we give you a statement detailing our information handling practices and contact details.

Where it is reasonable and practicable to do so, we will only collect personal information about you from you directly and not from third parties.  However, in many instances, this may not be practicable.  For example, personal information (including sensitive and health information) may be collected from members of your family especially where a family member is the member named as the policy holder in a family cover policy.  Also, we may collect it from:

  • hospitals and medical and other health service providers;
  • your employer if you are part of a payroll deduction scheme or similar; and
  • government agencies.

In particular, we will only collect sensitive (including health) information directly from you or from third parties with all necessary consents.  Where you are under the age of 16 years necessary consent may mean the consent of an appropriate adult who is most likely to be the member named as policy holder in respect of any family cover policy where there may be entitlement to benefits if you receive treatment. 

By supplying sensitive (including health) information about yourself or any dependant when making a claim for benefits or generally relying on any of our services which involve the collection of sensitive (including health) information from you or third parties, you will be taken to have given your consent to the collection of that sensitive (including health) information from you or those third parties and where dependants are involved, you will be taken to have given:

  • if the dependant is aged under 16 years, the consent of that dependant to the collection of the sensitive (including health) information about them; and
  • if the dependant is aged 16 years and over, the consent of that dependant to the collection of sensitive (including health) information about them and with the authority of that dependant.

Use and disclosure of your personal information

Latrobe collects, uses and discloses your personal information for a range of purposes.

We collect your personal information to enable us to provide the products and services you have come to expect from us as a  health insurer concerned with your interests.  These may include both health benefits cover and any general insurance taken out through our underwriter as well as a range of other products and services which we bring to you either directly or as agents for others, including travel insurance and ambulance cover.  We collect it also to enable us to fulfil our legal obligations as a private health insurer and as an agent for a general and travel insurer.  This personal information assists us in connection with the range of activities required to be undertaken by us to provide you with these products and services including:

  • establishing and maintaining your membership, which includes processing applications and related administrative tasks such as changes to contact details or other information;
  • processing health and general insurance claims and paying health benefits;
  • updating the terms and conditions of your membership from time to time in accordance with changes to fund rules;
  • providing you with information about products and services offered by us and others which we believe may contribute to the overall health of you and your dependants or meet your other insurance requirements;
  • collecting, compiling and disclosing data (including sensitive and health information) to governmental authorities where we are required by law to make such a disclosure;
  • administering general insurance policies on behalf of our underwriter and the policies or cover provided through others including travel insurance and ambulance cover; and
  • making any other use of disclosure of that information as may be required by law.

In the course of carrying on our functions and activities we may be required to disclose some or all of your personal information to a range of other individuals and organisations.  Some of these are individuals or organisations who provide services to us to assist us in fulfilling our functions and activities.  Others may be individuals or organisations with whom you have direct dealings and who have provided services to you.  The types of individuals and organisations to whom we may disclose your personal information include:

  • our agents who promote or assist us in administering or providing our products and services, such as, for example, printers, mailing-houses, IT companies, Internet Service Providers and other relevant service providers;
  • your employer if you are part of a payroll deduction scheme or similar;
  • hospitals and medical and other health service providers with whom you have had or may have a treatment episode and to whom fees may be payable;
  • our professional advisers;
  • government agencies, where we are required by law to disclose this personal information; and
  • our general insurance underwriter and other suppliers of products and services offered to you including travel insurance and ambulance cover.

We may also disclose your personal information to the member named as the policy holder (or any other person who lodges an authorised claim for benefits who would normally be the spouse of the member) where there is an entitlement to benefits under a family cover policy.  The named policy holder is responsible for payment of premiums and we are required to keep him or her informed concerning matters relating to the policy including levels of benefits available under the policy at any given time which in turn may depend upon the claims history of the policy. 

Security and quality of your personal information

Latrobe takes all necessary and reasonable steps to ensure that your personal information is accurate, complete and up to date.

We will also take reasonable steps to protect your personal information from misuse and loss and from unauthorised access, modification or disclosure in accordance of the requirements of the National Privacy Principles.

Requests for access to and correction of your personal information

Latrobe provides to you a right obtain access to your personal information that we hold in accordance with the Privacy Act. 

You may request details of the personal information we hold about you, or about any dependant aged less than 16 years or about any dependant of impaired capacity by writing to or contacting our Privacy Officer.

We will not charge a fee just because you make a request for access to your personal information.  However, we reserve the right to charge a fee for providing personal information in response to your request.

Depending upon the circumstances of your request for access, we may ask you to complete a personal information access request form, and require you to identify yourself and to prove your entitlement to receive the personal information that you request..

We will release to you details of the personal information we hold and which we are required by the Privacy Act to release.  Accordingly, we may not provide personal information in response to your request to the extent that it may not be appropriate and we are not obliged by law to do so.  For example, we may refuse your request where:

  • providing access would pose a serious threat (or in the case of personal information other than the health information, a serious and imminent threat) to the life or health of any individual; or
  • providing access would have an unreasonable impact upon the privacy of other individuals; or
  • your request for access is frivolous or vexatious; or
  • it is otherwise appropriate for us to refuse your request so that we can meet our obligations to you or others in accordance with the National Privacy Principles.

If we refuse you access to any personal information we will provide you with a reason for the refusal.  We may also consider the use of an agreed intermediary to receive the personal information rather than you if this is appropriate, or we may try to reach an amicable solution that  meets the needs of all concerned.

If you are aware that any of your personal information that we hold is inaccurate, incomplete or out of date please let us know so that we can update our file.  If any of your personal information is incorrect, we will correct that personal information or if we refuse to do so you will be provided with a reason for the refusal.  In any event, if we do refuse to make a correction, we will take reasonable steps to place with any disputed information a statement from you claiming that the disputed information, in your opinion, is not accurate, complete or up-to-date. 

Access and correction rights of young persons and persons suffering an impairment

Latrobe holds sensitive (including health) information relating to young persons and persons of limited mental capacity whether because of age or impairment.  In particular, Latrobe believes proper allowance needs to be made for the privacy requirements of persons aged 15 years and under, and for the mentally impaired (the " "special interest category" persons").

Where a request is made for access to the personal information (including sensitive and health information) of a "special interest category" person, Latrobe will respond to that access request  in the first instance by dealing with the person representing the interests of that person and initially Latrobe will assume that the member named as the policy holder is the appropriate representative.

However, if a "special interest category" person shows himself or herself to be capable of exercising sound judgement, Latrobe may chose to deal with that person to the exclusion of others.  In every case, Latrobe will respond to an access request in respect of a "special interest category" person and after having regard to the rights of the individual under the Privacy Act and the National Privacy Principles. 

Your right to complain

You can complain at any time to Latrobe about any actual or perceived breach of our privacy obligations to you.  Complaints about possible breaches of our privacy policy should be directed to our Privacy Officer.
